California Accident Attorneys.us hereby sets forth the following terms and conditions which shall govern this Agreement between California Accident Attorneys.us (hereinafter "CAA) and accident attorneys and others (hereinafter "Client") who desire to place a listing on California Accident Attorneys.US.
LENGTH OF AGREEMENT
The length of this Agreement is open ended and starts with the posting of submitter's listing information in the California Accident Attorneys.us.
SITE REVIEW FEE
CPIA does not charge a fee for site listings. It does, however charge a one time non-refundable review fee in the amount of $39.95 per listing for reviewing submitter's site in order to verify that it meets the requirements of CAA. Reciept by CAA of said fee does not guarantee placement of submitter's site listing in CAA and CAA reserves the right to refuse to list any site that does not meet it's requirements. Each listing is restricted to one city. Each additional city requires an additional review fee equal to the amount of the original fee.
SITE REQUIREMENTS
1. Listings are restricted to attorneys, lawyers and law firms only.
2. Only attorneys, lawyers and law firms the maintain a verifiable practice in a fields of accident or personal injury law will have their site listed in this directory. The practice need not be restricted toaccident cases or personal injury, however accident or other personal injury cases must be accepted and must make up a large part of the submitter's practice.
3. Listings will only be accepted for cities wherein the attorney, lawyer or law firm actually processes personal injury cases. If the practice forwards cases to outside attorneys in other cities no listings will be accepted for those cities.
4. Submitter must be a current member in good standing of the California Bar Association.
5. Submitter must not have had his, her or it's license suspended by the California Bar Association at any time within the last two years for any reason.
6. Submitters site must list a main or branch office address and telephone number. A residential address may be used providing that is where the submitter maintains it's practice. P.O. Box addresses are not acceptable.
7. Submitter's site may not defame any other attorney, lawyer or law firm.
LISTING PLACEMENT
Placement of Client's listing information shall be placed chronologically as submitter's listing, if approved, is approved by CAA.
TERMINATION
CAA may remove submitter's listing or listings at any time CAA deems that submitter is no longer in compliance with CAA's requirements. The original review fee is of course non-refundable.
LIABILITY
Submitter agrees that CAA shall have no liability for the services, data or information provided to the public on the Internet including but not limited to any liability for consequential, indirect, special or incidental damages, regardless of the success or effectiveness of other remedies.
Submitter agrees that it shall not hold CAA liable for any loss of business, lost opportunity, consequential, indirect, special or incidental damages as a result of any interruption in service.
JURISDICTION AND GOVERNING LAW
This Agreement shall be governed by the laws of the State of California and jurisdiction shall lie within the State of California. SUBMITTER HEREBY CONSENTS TO SUBMIT TO THE JURISDICTION OF THE STATE OF CALIFORNIA.
LEGAL ACTION
Submitter agrees to indemnify and hold CAA harmless in any legal action which arises as a result of submitter's site being listed in the CAA's directory, without limitation or exception including, but not limited to any action brought against submitter by a third party.
HEADINGS
Headings in this Agreement are for convenience only and shall not be used to interpret or construe these provisions.
MODIFICATION
The terms and conditions of this Agreement may be modified at the discretion of CAA with 30 days notice to submitter.
ENTIRE AGREEMENT
This Agreement supersedes all Agreements previously made between the parties pertaining to the subject matter of this Agreement. There are no other understandings or Agreements.
Failure to properly notify CAA via e-mail or regular mail of your disagreement with the above terms and conditions will constitute submitter's acceptance of same.
